Back in Washington from his Vail, Colorado vacation, President Gerald Ford summons CIA's Director of Central Intelligence (DCI) William Colby to the White House for a complete briefing. Ford is shocked by the assassination plotting described by Colby. Ford decides to form a commission headed by Vice President Nelson Rockefeller to report on the allegations in Hersh's story [see entry for 22 December 1973], but to appoint men who can "all be depended on for discretion." Ford and Kissinger want to quiet the uproar, get the lid back down, and leave the rest of the secrets in the "Family Jewels."

The Gerald Ford-appointed Rockefeller Commission is set up. The members include John T. Connor, C. Douglas Dillon, Erwin N. Griswold, Lane Kirkland, Lyman Lemnitzer, Ronald Reagan, and Edgar F. Shannon, Jr. The Commission is supposed to examine the malfeasance of the intelligence agencies and make recommendations about how they can be reorganized and reformed.

Quoted from Stipulation: "During the early part of January 1975, the defendant Hermann returned to the District of Columbia from his vacation and resumed his duties as supervisor of all Scientology covert operatives, who included the defendants Wolfe and Sharon Thomas and Ms. Nancy Douglass. The defendant Thomas was at the time a Scientology covert agent at the Coast Guard Intelligence. Ms. Douglass was a Scientology covert operative at the Drug Enforcement Administration (DEA) from where she stole documents and photocopies thereof and transmitted them over to the defendant Hermann."

OUTPOINTS: OMITTED DATA, DROPPED OUT TIME, CONTRARY FACTS: First, elsewhere the Stiulation claims that Sharon Thomas began her employment at Coast Guard Intelligence on 13 January 1975; here, it claims she is already in place. Second, where did all the covert operatives come from, long time passing? Where did all the covert operatives come from, long time ago... . The Stipulation does not tell how all these GO operatives got their inside jobs. There is also no exact date given; the date is reckoned from the 9 January entry [see]. Please, please, please note, also, that the Rockefeller Commission has just been seated to investigate Intelligence agencies. And the GO is merrily infiltrating them. La, de, da.

A handwritten note dated January 9, 1975, states "I attest that I have placed and am running an FSM at Silver [code name for the IRS] and am attaching the accompanying documents as evidence." Government handwriting expert James Miller positively identifies the note as having been written by Mitchell Hermann. [NOTE: the "FSM" is presumed to be Gerald Wolfe.]

OUTPOINTS: CONTRARY FACTS, OMITTED RECIPIENT: There is no mention of who this alleged note is addressed to. Also, the language of the Stipulation is what defines "Silver" as being "code name for the IRS." But later, the same Stipulation defines "Silver" as the code name for Gerald Wolfe. Seems like the government hack who dreamed this up couldn't keep his code names straight. But was it good for you?

Having been given operational data such as exterior photographs and geographical coordinates, Price has "visited" two foreign embassies--known to CIA audio teams who had made entries several years previously--by his remote viewing capability, has located the coderooms, and has come up with information to allow a member of the CIA team to determine whether Price is likely to be of operational use in subsequent operations. In both cases, Price has correctly located the coderooms. President Ford holds a luncheon in the White House for the publisher of the New York Times, Arthur Ochs Sulzberger, and some of his top editors, including the managing editor A. M Rosenthal. At the end of an hour or so of general discussion, Rosenthal asks Ford how he expects the Rockefeller Commission to be trusted when its membership is so heavily weighted by conservative figures with a history of hard-line political beliefs and sympathy for the military. Ford explains with unusual candor that the commission's mandate is strictly limited to CIA activities within the United States and he doesn't want anybody on it who might stray off the reservation and begin rummaging about in the recesses of CIA history. If they do, they might stumble onto things which would blacken the name of the United States and every President since Truman.

"Like what?" asks Rosenthal.

"Like assassinations!" Ford shoots back. And then it sinks in on him what he has said, and to whom he has said it. "That's off the record!" he quickly adds.

[NOTE: According to the referenced source, CIA people still find Ford's blunder hard to credit. Some of them suspect his indiscretion was in fact deliberate, and that he wanted the assassination story to get out for reasons of his own. How else is one to explain the fact that a President told the CIA's darkest secret to a newspaper?]

CBS television news correspondent Daniel Schorr has an appointment with DCI William Colby. Schorr mentions that he has learned that President Ford is worried about CIA involvement in assassinations. Colby falls silent.

"Has the CIA ever killed anybody in this country?" Schorr asks.

"Not in this country," says Colby.

"Not in this country!" exclaims Schorr.

At that point Colby shuts up; he will say only that assassination has been formally prohibited in 1973. From Colby's limited remarks, Schorr now concludes that the "assassinations" worrying Ford had actually taken place, but abroad, not at home.

All CIA funding of remote viewing and paranormal research purportedly comes to a halt. NOTE: The date can only be estimated from the language of the source reference. The source also says that about this time: "To achieve better security, all the operations-oriented testing [of remote viewing] with the contractor [SRI/Puthoff] was stopped, and a personal services contract with [Pat] Price was started."

OUTPOINTS: CONTRARY FACTS, ADDED FALSEHOOD: CIA funding of psi research does NOT stop. Numerous later entries in this database, documented and confirmed, prove that CIA involvement with SRI and remote viewing not only continue, but the budgets later increase. While it is true that there is greater Defense Intelligence Agency (DIA) involvement and funding of the programs later, there is absolutely no doubt about CIA liaison and involvement. If anything, what Kress describes here is merely an indication that the KNOWN funding of remote viewing and paranormal researh and development went further undercover and out of sight. And despite what the public is led to believe, all of the intelligence agencies are Cabinet agencies, all have tight liaisons with each other, and all are part of The Intelligence Advisory Committee (IAC), created to serve as a coordinating body in establishing intelligence requirements. Chaired by the Director of Central Intelligence (DCI), the IAC includes representatives from the Department of State, the Army, the Air Force, the Joint Chiefs of Staff, the FBI, and the Atomic Energy Commission (AEC). No reason is given. No indication of who replaced him. Also, in later entries, Hermann is allegedly still providing important information to senior GO officials regarding the covert operations in DC.

According to a letter written by Robert Vaughn Young to FBI Director Clarence Kelley [see entry for 30 April 1975], Young, on or around this date, is in Washington, D.C., and meets with James B. Clawson, Deputy Assistant Secretary of the Treasury, ostensibly to address the matter of getting false reports--in the possession of INTERPOL--corrected. According to Young, Clawon "is familiar not only with INTERPOL but with our request." Also according to Young, Clawson recommends a 26 March 1975 [see] meeting between GO WW's David Gaiman and Jean Nepote, Secretary General of INTERPOL in Paris.

According to a letter written by Robert Vaughn Young to FBI Director Clarence Kelley [see entry for 30 April 1975], and an FBI report [cited in SOURCE, below], there is a meeting on this date between GO WW's David Gaiman and Jean Nepote, Secretary General of INTERPOL in Paris. The purported purpose of the meeting is to correct reports maintained by INTERPOL, regarding the Church and LRH. Nepote is given documents to indicate the falsity of the reports in question.

OUTPOINTS: ADDED INAPPLICABLE SECRETARY GENERAL/DIRECTOR OF FBI: Bullshit. Why does the Secretary General of Interpol or the Director of the FBI (and/or his Intelligence agents) have to get involved to get some paperwork filed? Alternate explanation: Interpol was involved--with Henry Kissinger, of course, in liaison with CIA--in getting LRH to "flee" to the states in December 1972; Gaimon is their field co-ordination man in UK, Vaughn Young in the US.

In order to carry out target 17 of GO 1361, Michael Meisner obtains a directory of the United States Department of Justice in April 1975 and isolates those offices in the Tax Division which have been identified to him as offices which will have files related to pending Scientology litigation. Meisner has been informed by GO Legal Bureau that trial attorney Harold Larsen and Chief of Refund Litigation Section 3, Stanley Krysa, has represented the United States in the cases involving the Church of Scientology of Hawaii and the Church of Scientology of Florida. Larsen was the trial attorney assigned to these cases, while Krysa, as his immediate supervisor, had participated in the litigation. Meisner discovers that the Tax Division offices of DOJ are located in the Star Building at 1101 11th Street, Northwest, in DC. Meisner directs Gerald Wolfe to enter the offices of Krysa and Larsen to obtain all their files which are in any way related to Scientology.

Willardson invites Maren to come to the Information Bureau offices to view the documents "since the quantity of data is so extensive."

Monday, 28 April 1975

Richard Helms has his third day of testimony before the Rockefeller Commission on the subject of CIA assassinations, this time before the full committee in the office of the Vice President, where he is questioned for four hours. When Helms emerges at last, he finds Daniel Schorr waiting outside with three or four other reporters. Schorr steps forward, holds out his hand, and says, "Welcome back."

"You son of a bitch!" Helms shouts at Daniel Schorr, his face livid with anger. "You killer! You cocksucker! 'Killer Schorr'--that's what they ought to call you."

Schorr is stunned. Helms strides on toward the press room, continuing to shout at Schorr, who follows behind. When Helms gets before the cameras, he cools slightly. "I must say, Mr. Schorr, I didn't like what you had to say on some of your broadcasts on this subject. And I don't think it was fair, and I don't think it was right. As far as I know, the CIA was never responsible for assassinating any foreign leader."

Another reporter asks, "Were there discussions about possible assassinations?"

"I don't know whether I stopped beating my wife," Helms shoots back, "or when you stopped beating your wife--talk about discussion in government, there are always discussions about practically everything under the sun."

"Of assassinations?"

"Of everything under the sun."

"But you never answered my question," the reporter protests.

"Well, I'm not trying to answer your question," says Helms, and he terminates the press conference marching from the room. Schorr pursues Helms down the corridor and explains that it was not he but President Ford who had publicly raised the question of assassinations.

Deputy Guardian U.S. (DG US) Henning Heldt writes a letter to DG Info US, Richard Weigand. The letter refers to the November 21, 1973 order of Jane Kember which is attached. (Her letter, regarding Interpol files on LRH, had said, "[I]t is important that we get cracking and obtain these files and I leave you to work out how.") Heldt's letter says "while Legal is doing FOI [Freedom of Information Act] actions to obtain these (documents), please have B-1 [Information Bureau--Bureau 1] obtain them (the Legal route is at best lengthy.)"

Dear Mr. Kelley:

On March 26, 1975, a representative of the world wide offices of the Church of Scientology, David Gaiman, met with Jean Nepote, Secretary General of INTERPOL.

The purpose of that meeting was reports maintained by INTERPOL, regarding our Church and Founder, which are false and based upon conjecture. Mr. Nepote was given documents to indicate their falsity in the hope that the matter which has enjoined our organizations could be quickly and easily terminated.

It is in this same spirit that I am writing to you.

Mr. Nepote has promised to ask the appropriate national authorities in each country involved to authenticate the documents. In the United States, that will be the Federal Bureau of Investigation.

I have already met with James B. Clawson, Deputy Assistant Secretary of the Treasury, who is familiar not only with INTERPOL but with our request. It was he, in fact, who recommended the March 26 meeting. Therefore, I would like him to serve as the liaison to Mr. Nepote when the authentication is completed.

Since you can appreciate our desire to expedite this matter, I would like to meet with you this Monday, May 5th, at about 2 p.m. to present the documents in question. Should that time be inconvenient, another can be arranged as I have come to Washington, in part, to complete this matter. I can be reached at the above number and address.

Wolfe steals twelve separate files related to Scientology cases and photocopies them on a machine in the Tax Division offices. Robert Vaughn Young and Hugh Wilhere, are interviewed at FBI Headquarters in Washington, D.C. by FBI Deputy Assistant Director for Intelligence, Hunter Helgeson and FBI Special Agent, Intelligence (and Helgeson's Supervisor), William N. Preusse. The FBI report claims that Young has in his possession "copies of documents" indicating that Interpol has in its possession "information from the FBI" concerning the Church of Scientology and LRH. Young also, reportedly, has "other documents obtained by CS [Church of Scientology]"that Young claims refutes this information. Young reportedly tells the FBI agent "that information attributed to FBI came from West German Federal Criminal Police and an unknown reporter in Europe supposedly obtained from Interpol files and furnished to CS." [! See OUTPOINTS, below.] Young is advised that the FBI cannot authenticate any of the documents presented by him, and that "various representatives of CS" have requested information in Bureau files concerning CS and LRH through the Freedom of Information Act (FOIA). Young reportedly says that he doesn't want to wait for this to happen, and that he will be in contact with FBI Agent Helgeson again later in the week to see if he can get an immediate reply to his request.

OUTPOINTS: ADDED INAPPLICABLE INSANITY: Is this an indication that Young is trotting copies of STOLEN documents right into FBI Headquarters, with a watery story about an "unknown European reporter"?!

A CSW is sent by Gregory Willardson to DG I WW Mo Budlong and DG F WW Herbie Parkhouse. It explains that the collection of U.S. Government documents pursuant to GO 1361 has created a crisis in the Information Bureau by causing a slowdown in the collection progress which "urgently needs to be eliminated." Willardson says some "15,000" documents have been sent by the DC Information Bureau without excerption in order to speed up the process of advising DG US Henning Heldt and CSG Mary Sue Hubbard, "as fast as possible as to the IRS's intentions in regards to the Church during the ongoing IRS tax exemtion negotations." The CSW adds that "[t]his was a valuable action in that it resulted in a more real estimate as to the IRS scene than was visable [sic] from the Legal viewpoint." The CSW requests that GO WorldWide approve additional funds for the excerption, xeroxing and cross-filing of these "15,000" documents.

OUTPOINTS: ADDED INAPPLICABLE GOVERNMENT MATH: Okay. Okay. Now, let's do the math, shall we? Okay. Now, the very FIRST mention of any theft of documents in the Stipulation takes place on or around 2 December 1974 [see]. (That's your basic 10-inch stack of documents.) Okay. Now here we are at 7 May 1975, approximately 155 days later, and there have allegedly been some 15,000 documents stolen by our faithful GO spooks. Okay. Now, 15,000 divided by 155 days = 96.774193548 pages stolen PER DAY! Man, you'd think Meisner must have writer's cramp writing all that up every day! But, then, there's this other wrinkle. See, there have been, since 2 December 1974, only FOUR instances of thefts reported so far in the Stipulation. Hmmm. Okay. Let's see, then: 15,000 documents divided by 4 thefts gives us 3,750 stolen documents per theft! Wow! Hope they had a wheelbarrow! But, hold on a minute: we know from the Stipulation that one of the thefts only netted about 98 documents [see entry for 27 December 1974]. Okay: 15,000 documents, minus that 98, leaves 14,902 documents taken in 3 thefts, which equals 4,967 documents per theft! Rent a Ryder! But, no; even that can't be, because the first theft on 2 December 1974 was reportedly about a 10-inch stack. Let's call that three reams (1,500 sheets), to be kind, and so then we have the following formula: 15,000 (total stolen documents) minus 98 stolen in one trip = 14,902, minus another 1,500 stolen in another trip = 13,402 divided by 2 remaining trips = 6,702 DOCUMENTS PER THEFT! Somebody musta' got a hernia! (Could this math have possibly been done by the same boys in the government who whack out the budget each year?)

Robert Vaughn Young contacts FBI Deputy Assistant Director for Intelligence, Hunter Helgeson, again, and again goes into FBI Headquarters with Hugh Wilhere for an interview. According to the FBI report, "procedures on how to obtain Identification Record on Hubbard" are explained to Young. Young is also told that information desired by him from the FBI must be obtained through FOIA, and that he should contact "appropriate CS attorney." Young is also advised that if he desires information in his possession being made a matter of record with FBI, he should submit it, and it will be so noted.

OUTPOINTS: ADDED INAPPLICABLE "IDENTIFICATION RECORD ON HUBBARD": Why does Young want this? The use of fingerprints to "prove" LRH is alive becomes a vitally important issue in the years leading up to his death, and in the identification of his body immediately following his death, on 24 January 1986 [see].

A letter from Gregory Willardson, "Br I Dir US I", addressed to Michael Taylor, the "US Dir Sec WW" (U.S. Directorate Secretary World-Wide), routed via the DG I WW, the Guardian WW, the DG US, and the DG I US. The letter entitled "Re: B & E's Yours to DG I, 5 May 75, DG I's to you 14 May 75" states: "[A] large portion, if not the majority, of our high priority successful Collections actions fall into the category of second degree burglary, which is a felony. Some of our successful collections actions in the recent past and present which fall into this category are: (past)...GO 1361, GO 344...DEA; (present) GO 1361, Go 1344, DEA....[O]ne of the key points in solidifying the burglary commission is basically the theft of xerox paper and xerox machine use of whatever group is approached. Without this theft, then the distinction between 'b & e' and 'unlawful entry' would become important and could mean the difference between a felony and a misdemeanor... . Because the legal definition of burglary in the US to fit [sic] more spot on as to our actions than B&E and because it is a felony, as is a 'B & E' I thought you should be appraised [sic] of this."

Gregory Willardson directs Michael Meisner to implement "Project Horn" which Willardson has authored. "Project Horn" is to "provide a cover for PR [Public Relations] and legal for the way they obtained IRS docs," in accordance with GO 1361, Target 6. Willardson orders Meisner, as the Assistant Guardian for Information in the District of Columbia (sic--see Outpoints), the task of also stealing IRS documents concerning organizations other than Scientology, so that publication of the documents will not point to the Church of Scientology alone. The project also orders the theft of IRS stationery so it can be used by members of the Guardian's Office to draft false letters from a fictitious IRS employee disgruntled with the organization. The stolen documents would then be attached to the letters which would be sent to private orgzanizations such as Scientology.

OUTPOINTS: CONTRARY FACTS, ADDED INAPPLICABLE IDIOCY: According to the 1 March 1975 entry [see], Meisner is Acting Assistant Guardian for the District of Columbia (A/A/G DC)--NOT the A/G I DC, as he is referred to here. But the capper is the "fictitious disgruntled IRS employee" caper. Only a government-paid hack writer could dream this up, and believe in his own dim mind that even a 2-year-old couldn't see the absolute transparent lunacy involved in such a scheme.

A letter signed "Much Love, Mary Sue" (Hubbard), the Commodore Staff Guardian, addressed to Jane Kember and cc'ed to Henning Heldt, states "[o]ur overall strategy with the IRS shall be as follows: 1. [t]o use any method at our disposal to win the battle and gain our non-profit status. 2. [t]o buy all the time we can in terms of years...[s]o we
work to win, but also to delay as time works on our side, not theirs."

OUTPOINTS: CONTRARY FACTS, LIKELY ADDED FALSHOOD, ALTERED SEQUENCE: See 9 June 1975 entry, which is ostensibly a letter from Mary Sue that AGREES WITH the IRS Strategy. But here, almost exactly two weeks earlier, she is ostensibly ESTABLISHING the IRS strategy. One of these alleged letters, or both, must be false, and is evidence of likely forgery.

Pam Kemp, LRH's old friend from Saint Hill days, arrives at the Apollo for courses. She is shocked to see how much he has aged. "I saw this figure coming on board in a big hat and red-lined Navy Cloak and I thought if I'm not mistaken that's LRH, although he was very slow and old looking. I went up to him and said, 'Hi, Ron.' He looked through me like he didn't know who I was. I thought maybe he was a little deaf so I went around another way and as he was coming towards me I said, 'Hi, Ron. How are you?' He didn't recognize me, didn't know who I was. I thought, how weird. Later I discovered he probably didn't see me properly because he needed glasses, but would never wear them."

Gregory Willardson, in a handwritten letter addressed to "A/G I DC" [sic--see OUTPOINTS, below] Michael Meisner, directs Meisner to complete target 10 of GO 1361 which calls for the placing of "an agent in DC IRS to obtain files on LRH, Scientology, etc." by "no later than 30 August." Willardson says that, based on a conversation with Mitchell Hermann, it appears that the only documents still to be obtained are from "(1) OIO [Office of International Operations], (2) Intell [Intelligence], (3) SSS [Special Services Staff]" of the Internal Revenue Service. Willardson adds: "Mitch explained to me that he had planned to get Silver in OIO, and hopefully gain access to Intell via OIO. Further, that all SSS does no longer exist in IRS but some were given over to Intell--thus Mitch expected to get SSS via Intell. What I need from you is your plan of action here on how to complete target 10 no later than 30 Aug... ." The letter says, "[i]f you are going to need to get another FSM in you'd have to start soon as it takes some time, etc." Willardson demands a response "in project form within 24 hrs," and asks "When will Silver be in OIO?" NOTE: OIO is, at this time conducting an audit of LRH and MSH [see entry for 02 c. July 1973. Also, Meade Emory is Assistant to the Commissioner of IRS.

OUTPOINTS: CONTRARY FACTS: 1. Meisner is supposedly Acting A/G DC--not A/G I DC. 2. Mitchell Hermann has been transferred to Chicago, and is supposedly not involved in the DC covert ops anymore. 3. There is already an agent, Gerald Wolfe, in DC IRS, and, allegedly, over 15,000 files have already been stolen. 4. The Stipulation previously defines "Silver" as the code word for IRS; here it is being used as a code word for Wolfe (and is unequivocally defined that way in another sentence in the Stipulation, which says: "'Silver' [the code name for Gerald Wolfe].")

A letter to Henning Heldt from Mary Sue Hubbard, entitled "IRS Strategy," says: "I agree with the strategy completely as laid down."

OUTPOINTS: CONTRARY FACTS, LIKELY ADDED FALSHOOD, ALTERED SEQUENCE: See 27 May 1975 entry, which is ostensibly a letter from Mary Sue that ESTABLISHES the IRS Strategy. Now, almost exactly two weeks later, she is ostensibly AGREEING with the IRS strategy. One of these alleged letters, or both, must be false, and is evidence of likely forgery.

Complying to "Project Horn," Gerald Wolfe allegedly takes stationary from IRS and turns it over to Michael Meisner. Wolfe also allegedly steals IRS documents related to Bob Jones University in South Carolina and the Unification Church. After receiving the documents from Wolfe, Meisner notifies Gregory Willardson that he has complied with the preliminary steps of "Project Horn."

The Rockefeller Commission's final report, "The Report to the President by the Commission on CIA Activities Within the United States," is made public. The report is said to have been "five months in preparation." It states that the CIA has engaged in activities that were "plainly unlawful and constituted improper invasions upon the rights of Americans." The report also claims, though, that the "great majority" of the CIA's domestic activities in its 28-year history have been in compliance with its "statuatory authority." [NOTE: The Commission has also investigated reports of CIA assassination plots. President Ford chooses to withhold this information because he considers it is "incomplete" and "extremely sensitive."]

Michael Meisner prepares a project entitled "Beetle Cleanup." The project calls for obtaining "all DC IRS files on LRH, Scientology, etc., in the Intelligence section, OIO, and SSS." It proposes the placement of "FSMs" in the "required areas or good access developed," and further that "Pitts" (the code name for Nancy Douglass) and "Silver" attempt to obtain employment at the IRS Intelligence Division and Office of International Operations respectively. Appended tis a letter signed by Meisner addressed to Gregory Willardson, stating that Meisner is attaching a project in "compliance to your attached order." It says that the only road block is the fact that Nancy Douglass a/k/a "Pitts" still has three files to obtain from DEA and that no positions might be available in the two IRS areas contemplated by the project. NOTE: OIO is, at this time conducting an audit of LRH and MSH [see entry for 02 c. July 1973. Also, Meade Emory is Assistant to the Commissioner of IRS.

It says that the overall strategy laid out in that order was as follows: "To use any method at our disposal to win the battle and gain our non-profit status." It further outlines that "B-I's [Bureau 1] major action is the completion of its GO 1361 collection targets, and working out the means to turn those over to legal and PR for use. Bureau I's actions are moving along steadily and full completion is expected in two to three months."

Gerald Wolfe enters the office of Lewis Hubbard, of the IRS Chief Counsel's Office, to obtain documents related to the "Church of Scientology of California's pending audit." Michael Meisner then meets with Wolfe and receives copies of the documents. Meisner produces a memorandum, "Present IRS Situation," saying that the fifty-seven pages of appended documents "are the daily notes of Lew Hubbard," and summarizing the documents. He appends the stolen documents, and sends the package to Cindy Raymond, with copies to CSG Mary Sue Hubbard. The memorandurm is routed through the DG US Henning Heldt, DGI US Richard Weigand, and the Information Branch I Director US, Gregory Willardson.

United States Court of Appeals, Ninth Circuit, in case No. 74-1487, reverses the 15 November 1973 [see] ruling by U.S. District Court, Central District for California in "US et. al v. CSC et. al" and remands the case to the lower court for an evidentiary hearing:

"[W]e conclude that the Church's allegations of bad faith harassment by the Service, though thin, raised sufficient doubt about the Service's purposes to require the district court to hold a limited evidentiary hearing to determine whether further inquiry into the Service's purposes by way of discovery is warranted. Although we anticipate that such a hearing would entail, for example, cross-examination of the summoning agent ...we do not attempt to define precisely the permissible scope of the evidentiary hearing. We leave that to the discretion of the district court. ...

"IV. Conclusion.

"In view of our conclusion that the district court should have granted the Church a limited evidentiary hearing to inquire into the Service's purposes, we do not reach the Church's other arguments for reversal.

"Reversed and remanded for further proceedings."

Entitled "Snow White Confidential," it orders that the Guardian's Office must: "Through infiltrators or clandestined agents obtain all details of any reports of requests for data on LRH, Scientology, OTC (Operations and Transport Company), Apollo, etc. from US and/or US NCB (National Central Bureau of Interpol) to IP (Interpol) International or any other NCB to US Police and/or US NCB." Pat Price has reportedly "finished his stint with the coal company in West Virginia." The referenced source makes the curious observation:"The job hadn't been a cover for his CIA work. He had actually worked for the enterprise." For some reason, though--unexplained--he charters a plane around this time and flies CIA agents Ken Kress, Richard Kennett, and "some other CIA officials" out to the coal company, in Huntington, West Virginia. No reason is given why CIA officials would be flying out to meet Price at a coal company.

A letter from Duke Snider to DGI US Richard Weigand, entitled "Re: GO 1361," reviews accomplishments of the Information Bureau. Referring to target 10, he says that "IRS DC is progressing," and that Gregory Willardson has ordered the DC GO to complete by 30 August 1975 the collection of all documents called for by target 10. Snider says that target 10 is proceeding on schedule. Referring to target 17, to "infiltrate selected areas of the Justice Dept Tax Div for all files on us," he complains that no data has been received on "the status of Tax Div DC action." He orders that if target 10 files have not been obtained, "do a project to get them and complete the DC aspect of this tgt." He admonishes Weigand to "consider this a high priority matter and get these actions quickly done."

LRH reportedly suffers a minor stroke while the ship is in harbour in Curacao. He is rushed (by Kima Douglas) to the local hospital, kept in intensive care for two days and then transferred to a private room, where he stays for three weeks.

Pat Price, on a "personal services contract" with the CIA, is given a "second requirements list" for things the Libyan Desk of the CIA wants to know regarding a Libyan installation that Price had earlier (date unknown) identified with remote viewing as a guerilla training site. According to the source, CIA Project Officer Dr. Kenneth Kress, "Price died of a heart attack a few days later, and the program stopped." NOTE: This date is reckoned from the date of Price's death in Las Vegas.

Pat Price continues his trip west. He goes on to Utah "for a brief visit with his son" [see OUTPOINTS, below], and on from there to Las Vegas [reason ostensibly because he loves gambling], Price is planning to go on from Vegas, after a few days, to SRI, then to Los Angeles to visit his wife. In Vegas, Price is accompanied by an old friend named Bill Alvarez and his wife, Judy. The three check into the Stardust Hotel, rest, and go into the restaurant for dinner.

Price begins to complain that he doesn't feel good, and ostensibly tells the Alvarezes that someone "had seemed to slip something into his coffee" at dinner in Washington "the night before" [sic--see OUTPOINTS, below]. He seems serious about it. Price soon feels so bad that he goes up to his room to lie down. He feels even worse, and calls the Alvarezes. They come to his room and find him on the bed in cardiac arrest. Bill Alvarez calls paramedics, who try without success to resuscitate Price with defibrillator paddles. Price is declared dead in the local hospital's emergency room.

Reportedly, a mysterious "friend" of Price's turns up at the emergency room with "a briefcase full of his medical records," which, along with the statments of the emergency room's physician, apparently are enough to waive an autopsy--which would normally be performed on an out-of-towner who had died outside the hospital. NOTE: CIA'S Richard Kennett allegedly later tries to "track down" the mystery man with the briefcase, but, reportedly, "never found out who he was, or whether he even existed."

OUTPOINTS: DROPPED-OUT TIME, ADDED INAPPLICABLE MYSTERY MAN: The "brief visit with his son" must have been brief indeed, since Price allegedly tells the Alvarezes that he had been in Washington having dinner THE NIGHT BEFORE. That means that Price could only have stopped in Utah only long enough to see his son at the airport before going on to Las Vegas. The "mystery man" with the briefcase bears no further comment, especially since the CIA's own agent, Richard Kennett, was never able to discover anything at all about "him."

Cindy Raymond informs Michael Meisner that the Church of Scientology has initiated a Freedom of Information Act (FOIA) lawsuit against the IRS and directs him to be alert to any documents in the offices of Charles Zuravin, an attorney in the Disclosure Division of the IRS Chief Counsel's Office, since Zuravin is representing the United States in that FOIA case. Meisner immediately notifies Gerald Wolfe and instructs him to add Zuravin's office to the list of offices in the IRS's main building which Wolfe has to constantly monitor.

OUTPOINTS: ADDED INVISIBLE LAWSUIT: There is no "FOIA lawsuit" that can be found between CSC and IRS--certainly not around this date, or that Cindy Raymond (in L.A.) would be "informing" Meisner (in D.C.) about. The only known FOIA suit filed by CSC at this time is the one filed 14 June 1974 [see] by the Founding Church of Scientology of Washington, D.C., Inc., naming the Director of the FBI, the Attorney General and the Secretary of the Treasury--not the IRS, per se.

In a letter from Peggy Tyson, the Information Bureau Programs Officer, to Duke Snider, she says that she has contacted DC and that "tgt 17 IS done." Tyson telephones Michael Mesiner and asks him to immediately send a dispatch to Cindy Raymond outlining the status of all target 17 actions and indicating what remains to be accomplished.

Gerald Wolfe makes his first entry into Charles Zuravin's office and copies Zuravin's file on the pending Freedom of Information Act lawsuit. He turns the copies over to Michael Meisner, who summarizes the documents in a memorandum addressed to Cindy Raymond, with a copy to CSG Mary Sue Hubbard. [NOTE: This is the FIRST of what should be only FIVE illegal entries by Wolfe into Zuravin's office. The Stipulation says there were FIVE, with the results of each summarized by Meisner in a memo to Cindy Raymond. But then the stipulation actually describes SIX entries. While convalescing (from his reported stroke) in a bungalow at the Curacao Hilton, LRH despatchs an aide, Mark Schecter, to the United States on a top secret mission. Schecter carries a suitcase full of money ($50,000). His orders are to hand it over to Frankie Freedman, who has found a motel for rent (the Neptune) in Daytona Beach, Florida.

In a memorandum to Cindy Raymond, "GO 1361-TGT 17 STATUS," Michael Meisner says that "Peggy [Tyson] asked me to send you a dispatch re the areas checked for target 17 of GO 1361." He says that the only data found in the Tax Division was in the offices of Krysa and Larsen,and that the only areas in the Justice Department that should be checked "all [are located] in the main Treasury [sic] building" and "would require infiltration--probably several different FSMs."

Flag crew are beginning to arrive in Daytona by various routes, and moving into the Neptune motel. The Apollo has been left in Freeport, Bahamas, with a skeleton crew, to be sold.

Lynette "Squeaky" Fromme, 26, a Manson family follower, attempts to assissinate President Gerald Ford in Sacramento, California, with a 45-calibre pistol that has four bullets in it--but none in the firing chamber. She is subdued by Secret Service men and the gun taken from her.

In a letter headed "CONFIDENTIAL--SHRED WHEN FINISHED," Cindy Raymond tells Michael Meisner that there may have been some confusion regarding GO 1361, target 17, so she is reissuing it. She reminds him that targets 16 and 17 require the infiltration of the Justice Department Tax Division to obtain all files on Scientology, and instructs him that "[w]hat you need to do to comply to this is survey all areas that we have checked, and then take a look at any area (Tax Div) that we need to check and then get the data." (The Stipulation says that Meisner then notifies Raymond that all documents from the DOJ Tax Division relating to Scientology have been already obtained. But there is no date or document for that.)

Weigand allegedly writes a handwritten note on the memo stating that target 17 "is almost done" in DC, but still requires six weeks to be completed at the Justice Department Tax Division in LA.

"By early October 1975," IRS attorney Charles Zuravin has completed an FOIA index regarding all IRS documents relating to Scientology, and has sent it to "Scientology attorneys" [who allegedly have a pending FOIA case]. In preparing the FOIA index, Zuravin has numbered each document to facilitate locating them. "Within the next few days," Cindy Raymond sends a copy of that index to Michael Meisner with a directive to obtain all documents that Zuravin has concluded are exempted from the FOIA.

OUTPOINTS: OMITTED CASE CITE: There is no known FOIA case against the IRS, per se, at this time. The cases that might have bearing on this include the following: 1) On 14 June 1974 [see], Founding Church of Scientology of Washington, D.C., Inc., has sued the Director [of the FBI], the Attorney General, and the Secretary of the Treasury for information in government files which the Church contends have been wrongly disseminated. This might be an FOIA suit, and one that is still pending on this date, but no ruling or other reference to this suit has been found. It does not appear to name IRS, per se. 2) On 26 June 1975 [see], a court of appeals has reversed and remanded to the District Court the adverse ruling against CSC in case No. CV74-3465-RJK, United States District Court; C.D. California: Church of Scientology of California, a non-profit corporation, Plaintiff v. Internal Revenue Service, Donald C. Alexander, Commissioner of Internal Revenue, Department of the Treasury of the United States, William Simon, Secretary of the Treasury of the United States, Defendants [see entries for 26 November and 12 December 1974]. As of the date of this entry, this case may be being re-heard by the District Court. 3) On 19 December 1974 [see], CSC has filed FOIA requests for records from the U.S. Treasury, the U.S. Secret Service, the Secretary of the Treasury, and the Director of Secret Service, including requests for documents from the Treasury Department's Office of the Assistant Secretary for Enforcement, Operations, and Tariff Claims (EOTA). This does not appear to be a lawsuit, per se. There is no evidence of what became of these requests.

GO 1361-1 calls for placing additional "FSMs" into the LA and DC "target areas," and preparing the stolen government documents for release to the press and for use in possible Scientology legal cases. President Gerald Ford dismisses Secretary of Defense (and previous CIA Director) Dr. James R. Schlesinger, as well as the current CIA Director, William Colby. Ford also asks Henry Kissinger to resign his post as National Security Advisor at the White House, but to stay on as Secretary of State. Kissinger agrees. Ford designates George Bush--US Envoy to the People's Republic of China--to take over as Director of Central Intelligence (DCI). [NOTE: Because of delays in Bush getting back to the States, Ford has to ask Colby to stay on his post temporarily.]

[NOTE: According to the stipulation, Wolfe doesn't even receive the FOIA-exempt index list until around the 18th of November (see)--ten days later! The "foot of material" being referred to can only be in Zuravin's office, and Wolfe would have to ALREADY HAVE THE LIST. NOTE, also, that this is the mysterious SIXTH of what should be only FIVE entries by Wolfe into Zuravin's office. See OUTPOINTS, below.]

OUTPOINTS: ALTERED SEQUENCE, CONTRARY FACTS: The Stipulation says that after the first illegal entrance to Zuravin's office, on or about 28 July 1975 [see], "[t]he defendant Wolfe made four additional illegal entries into Mr. Zuravin's office at the IRS between mid-September and late November 1975"--for a total of FIVE entrances. All five of those are accounted for from Meisner's memoes summarizing the documents taken on those occasions. Those memos are dated 24 September, 30 September, 10 October, and 20 November 1975 [see]. Yet here is a description of another purported foray into Zuravin's office, with "a foot of material" being taken. This is a SIXTH, and important, incident, while the Stipulation asserts that there were only FIVE total, and that tthe stolen material from each was summarized by Meisner in memoes to Cindy Raymond--of which there are five. Note, also, that the incident that fits the description for the FIFTH entrance into Zuravin's office comes lLATER--see database record for 18 Novermber 1975.

In a letter to Cindy Raymond, Michael Meisner encloses a copy of the list of withheld IRS documents exempted under FOIA which he ostensibly has given to Gerald Wolfe, prepared from the FOIA index which Raymond "had sent him." [NOTE: According to the Stipulation, Meisner doesn't give the exempt list to Wolfe until around 18 November 1975(see). See

OUTPOINTS, below.] Meisner allegedly tells Raymond that "Silver" (defined variously in the Stipulation; here used as being a codename for Gerald Wolfe) "is methodically making copies of all documents listed." He says that Wolfe, over the previous weekend, has taken "a foot of material" (stolen documents) from the IRS and is already through the third column of numbers on the index list. Meisner estimates that an additional two weekends will be needed to acquire all remaining documents.

OUTPOINTS: CONTRARY FACTS: These documents, according to the Stipulation, would have to have come from Zuravin's office. The Stipulation contradicts itself in first asserting there were only five incursions into Zuravin's office, accounted for by Meisner memoes summarizing what was taken each time. Yet here is a SIXTH, and important, incident, with "a foot of material" being taken, and there is no indication of the usual summary of that "foot of material" being done by Meisner. Also, the Stipulation claims Wolfe got the FOIA-exempt list on or around 18 November 1975 [see]. Note also the reference to "Silver" being the code name for Gerald Wolfe, when the Stipulation earlier defines "Silver" as being the GO's code name for IRS.

A Finding and Order to Show Cause is issued against HASI, Inc. by the Arizona Corporation Commission due to failure to pay prescribed fee and failure to "file the report as proscribed by Section 10-211 Arizona Revised Statutes." It threatens termination of the right to transact or do business in the state of Arizona, with a hearing scheduled in Arizona before the Commission on 16 December 1975. It is signed by Evo J. De Concini, Secretary, Al Faron, Chairman, Ernest Garfield, Commissioner, and Bud Tims, Commissioner. NOTE: There is no record of any such hearing ever taking place.

An annual report is filed for HASI, Inc. with the Arizona Corporation Commission by Anne Ursprung Burgess, President, and Joel Kreiner, Secretary. The microfiche record is illegible in the area that defines the fiscal year, but it is assumed to be for the fiscal year ending April 1975. Copyrights are listed on the form under "Intangible Assets, Goodwill," and valued at $7,463. NOTE: There are several copies, and the dates of the relevant fiscal years are obliterated by the grunge of the microfilm. These could be two separate annual reports--one each for fiscal years 1974 and 1975--because both years were apparently outstanding and overdue, according to an Order to Show Cause issued by the Arizona Corporation Commision [see entry for 12 November 1975], but it is impossible to tell from the available records. This, by all available information, is the last annual report ever filed for HASI, Inc.

Gerald Wolfe makes his "fifth and last entry" into Charles Zuravin's office on or about 18 November 1975, ostensibly "[u]pon receipt from Michael Meisner of the list of IRS documents exempted from FOIA disclosure" [see outpoints, below]. He makes copies and turns the copies over to Michael Meisner. (NOTE: This is the FIFTH of what should be only FIVE illegal entries by Wolfe into Zuravin's office. The Stipulation says there were FIVE, with the results of each summarized by Meisner in memoes to Cindy Raymond. But then the stipulation actually describes SIX entries. See the records in this database for 8 and 10 November 1975.)

OUTPOINTS: CONTRARY FACTS: See note above re: the mysterious SIXTH entry. Also, the stipulation makes the odd statement regarding this incident, that Wolfe made this entry: "Upon receipt from Michael Meisner of the list of IRS documents exempted from FOIA disclosure." But elsewhere the Stipulation claims that Wolfe already had that list as early as 8 November [see]--the time of the mysterious SIXTH entry into Zuravin's office.

Michael Meisner sends a memorandum, "Re: Withheld IRS FOI Documents #108-141," to Cindy Raymond, with a copy sent to CSG Mary Sue Hubbard. It summarizes the copies of documents allegedly taken within a day or two before from Charles Zuravin's office by Gerald Wolfe during his FIFTH, and last, illegal entry into Zuravin's office.

The referenced source (BFM) claims that LRH approves "a Guardian's Office proposal to infiltrate agents into the US Attorney's offices in Washington DC and Los Angeles with the specific task of providing an early warning of any legal moves against him." The source is referring to GO Order 261175, with an issuance date of 26 November 1975 [see entry for that date]. The source says this GO Order is called "Program LRH Security," and quotes its "first priorty" as being: "Maintain an alerting Early Warning System throughout the GO N/W [Guardian's Office network] so that any situation concerning govts or courts by reason of suits is known in adequate time to take defensive actions to suddenly raise the level on LRH personal security very high." NOTE: The date of this entry is selected as being several days before the issuance of the GO Order, since it is claimed that LRH approved the order himself.

OUTPOINTS: MAJOR OMITTED FACT: Why doesn't the Stipulation of Evidence even mention LRH's personal approval of ths VERY damning order,?! This would have made him an INDICTED co-conspirator in the government's case against Mary Sue, et. al. How does Russel Miller know that LRH personally approved this order, and the government DIDN'T?!

The IRS moves all Scientology-related documents from Zuravin's office to a file room (which had previously been the office of Helen Bumbry) across the hall which has a more secure lock. The Stipulation states: "Consequently, the defendant Wolfe was unable to continue to obtain the remaining documents until sometime in January 1976 when, with the assistance of Mr. Don Alverzo, that office was forced open with lock-picking equipment." NOTE: the date is reckoned from alleged date of Gerald Wolfe's last entry into Zuravin's office, which was on or around 20 November 1975. It is unlikely, but possible, that the move occurred 22-23 November, a Saturday and Sunday.

OUTPOINTS: CONTRARY FACTS: Later in the Stipulation, it claims that the Scientology documents are inaccessible because, "In November 1975, the Office of Messrs. Charles Zuravin and Lewis Hubbard were placed within a 'red seal' or high security area inside the main IRS building in Washington D.C." Here, though, it says that just THE DOCUMENTS were moved ACROSS THE HALL. (Compare database record for 14 c. February 1976) Also, this claim of the office being opened with lockpicking equipment turns out later in the Stipulation to be contradicted. See database record for 18 January 1976.
